TERMS AND CONDITIONS
Confirming the booking
A booking is only confirmed when the booking deposit has been received and cleared.
All bookings take effect immediately upon receipt of deposit. Payment of deposit by any method is deemed as the client’s acknowledgments and acceptance of these Terms and Conditions.
Payment of fees
The agreed booking deposit is due strictly within 14 days of initiating the booking (£50). Unless otherwise agreed in advance of the event by silver djs, the balance is payable to the DJ in cash on the day of the event prior to the DJ starting. Clients wishing to pay the outstanding balance by other methods (cheque/paypal/bank transfer) must ensure that this is agreed with silver djs and that silver djs is in receipt of the full balance 10 working days prior to the event.
The terms of this agreement do not allow for cancellation other than by mutual consent of both parties and confirmed in writing.
Cancellation by the client:
I) In the event that the client cancels the booking, the client agrees to inform silver djs immediately.
II) Any cancellations made at least 90 days prior to the date of the event will just forfeit the deposit paid.
Cancellation by Silver DJs:
I) In the very unlikely event that silver djs cancels the booking due to unavoidable circumstances, silver djs agrees to inform the client of the cancellation and make all reasonable attempts to find a suitable replacement DJ of similar standard and style, at no extra cost to the client. Should a suitable replacement not be found, silver djs agrees to refund the client their deposit plus any other booking fees already paid in advance.
Changes on the day
Where possible, changes to the schedule which are unavoidable on the day of the event should first be discussed & agreed with silver djs. Should this not be possible, changes are to be agreed between the client and the DJ prior to their performance. Any changes will be subject to these terms and conditions.
Changes negotiated between the client and the DJ on the day of the event and any extra fee’s are agreed upon the client must pay these extra fee’s along with the remaining balance of the booking fee. In the event that the DJ’s performance is delayed due to unavoidable circumstances, liability is limited to providing the client with performance time equal to time lacking or a discount/refund at a pro rata rate based on the time of commencement of music. Any delayed set up time or subsequent delayed start time due to the overrun of any prior proceedings or of situations being outside of silver djs control will not warrant any extension of the stated finish time or any fee reduction. However, at the sole discretion of the DJ and with the permission of the venue management, an extension of these performing times may be made. The DJ will charge an additional fee. This fee must be paid in cash to the DJ before any extra time commences. The client must supply a minimum of one hour to enter a venue and set up prior to the start time and also a similar time allowance at the end of the night to pack up. This time can be reduced if access is good and the DJ is familiar with the venue. If access to the venue is difficult e.g. stairs, distance from unloading area etc. The client agrees to provide assistance with getting all of the DJ’s equipment to and from the required area.
Silver DJs guarantee
The DJ agrees to provide a performance that is to the best of their ability, and reflects fully the likeness of the DJ show, as known to and as advertised to the ‘client’ via pictures, videos, web page etc. The DJ will make every effort to ensure their performance is outstanding, adhere to the client’s wishes within all reasonableness, be polite and courteous with the client, their guests and all venue staff and contractors. The DJ agrees to provide all equipment required to undertake this performance, unless the equipment has been contractually agreed to be provided by the ‘client’ or a third party. The DJ agrees that their fee is inclusive of all expenses (except those that have been itemised or accounted for separately ), travelling expenses to and from the venue, VAT, tax, N.I. etc and covers any payments whatsoever due to other members. The DJ will not display any conduct deemed anti-social, illegal, nor reflecting badly upon themselves, silver djs, or the ‘client’. The adjustment of the volume and sound level of any equipment shall be as the client reasonably requires whilst working under any restraints that the venue may apply.
Silver DJs will make every reasonable effort to supply and play requests that are advised up to 14 days in advance of the event. The client agrees to provide silver djs with any music that they have requested where silver djs has informed them that he is unable to supply it. The DJ will make reasonable effort to play as many additional requests notified by the client and those canvassed from guests during the evening (unless the client has specified that they do not wish guests to make requests), as they can, however, there is no guarantee that all requests will be played. The DJ reserves the right to refer any requests of a questionable nature to the client or the venue management.
It is agreed by the client and the DJ that the equipment and instruments of the DJ are not available for use by other performers or persons except by specific permission of the DJ. Where permission had been given for use of the DJ’s equipments by others, silver djs will not be responsible for its working order or any problems to other services it may cause. In the unlikely event the DJ’s performance is delayed or terminated due to major equipment failure i.e. music is unable to be played, liability is limited to providing the client with a pro rata rate discount/refund of the booking fee from the time of termination. The DJ accepts no liability for minor equipment failure i.e. failure that does not result in termination of music. Silver DJs accepts no liability for equipment failure/music termination caused by any ‘Sound Limiter’ shutting off the supply of electricity to the DJ’s equipment. All equipment is subject to availability and used according to the rules of the venue and health and safety where we see fit. The client must seek explicit permission from the venue to enable the DJ to use the haze or the bubble machine. This equipment will not be used unless silver djs has been notified in advance of the event that permission has been granted. The client must ensure protection of the DJ’s equipment from adverse weather conditions, where the DJ’s location is not inside e.g. gardens, marquees etc. The client will be fully liable for any damage to equipment, caused by adverse weather conditions. Payment for any damaged equipment should be received by silver djs within 7 days of the event or further costs may be charged. It is the responsibility of the client to ensure that there is an adequate provision of electrical power within ten metres of the DJ’s set-up point
Withdrawal Of Services
In case of verbal and/or physical violence towards the DJ’s or any person/person’s connected with silver djs, the client will be asked to have this/these people removed from the venue. If an agreement regarding this cannot be resolved then the services of silver djs will be stopped, and the client will be liable for the remainder of any booking fee’s due. In the case of damage being caused to any equipment (either belonging to contracted to or leased to silver djs) by the client or any person/person’s at the event, the service’s of silver djs may be stopped, and the client will be liable for the remainder of any booking fee’s due, and the client will also be fully liable for any damage to equipment, payment for any damaged equipment should be received by silver djs within 7 days of the event or further cost’s may be charged.
In cases of ‘Force Majeure’ (which shall be known as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God), which are not attributable to any act or failure to take preventive action by the DJ or client, then the DJ or client may cancel this booking without penalty other than loss of deposit.
Any issues that arise during the event must be communicated to DJ at the time that they arise in order for the DJ to have an opportunity to solve the issue. The DJ is unable to resolve issues if they are not aware of any situation that may occur during a performance. In the unlikely event that you should feel dissatisfied with any aspect of services provided by silver djs and the issue was not resolved during the event, the client must contact us in writing to within 48 hours of the end of the event. Silver DJs will not enter into any discussions with regards to the individual DJ’s presentation style or content as this is a subjective interpretation. In the unlikely event there is a requirement for reimbursement of fees paid, not covered elsewhere in the Terms and Condition, it is limited to the fee paid.
Photos, Filming, and Testimonials
During your event I may take photos or films relevant to the marketing of silver djs. These photos of films may be used on my website or on social networking sites linked to silver djs. If you do not want any photos or films of your event to be used for this purpose please inform me within 48 hours of your event. Written feedback that I receive from events may be used for the purpose of marketing silver djs. This feedback may appear on my website. If you do not want your feedback to be used for this purpose please inform me at the time of sending it.
Health & Safety Mission Statement
Silver DJs will strive to ensure a safe working environment for all employees and those affected by our acts and omissions. Our standard activities shall be risk assessed and then regularly monitored and reviewed. Where risks are identified we will strive to minimise them in order to prevent accidents and work related health issues. On arrival at any venue we shall familiarise ourselves with the emergency arrangements and cooperate fully with health and safety policies & procedures. This policy will be kept up to date with regular reviews, consultation with safety professionals as required and shall also reflect any legislative changes.
